Shardul Amarchand Mangaldas & Co. advised Pembroke Aircraft Leasing 11 Limited, Jackson Square Aviation Ireland Limited, Bluesky 19 Leasing Company Limited, and Bluesky 31 Leasing Company Limited (collectively, “aircraft lessors”) on various aspects concerning insolvency and aviation law, appearing before the Supreme Court, Delhi High Court, and National Company Law Tribunal. SAM & Co represented 14 aircraft valued at approximately USD 560 to 700 million. The entire dispute pertained to 54 aircraft worth USD 2160 to 2700 million.
This is one of the first case where the High Court was deciding whether the DGCA is empowered to reject the de-registration of the aircraft under Rule 30(7) of the Aircraft Rules, 1937 on the ground that CIRP has been initiated against the erstwhile lessee, in the present case, Go Air.
