In view of the difficulty being faced by companies to hold AGMs due to Covid-19 lockdown, the MCA has clarified that companies whose financial year (other than the first financial year) ended on 31 December 2019, their AGMs may be held within nine months therefrom (instead of six months), that is, by 30 September 2020 This will not be held to be a violation and any reference to due date of AGM under the Companies Act 2013 and rules made thereunder shall be construed accordingly.
