On 12 March 2024, the Ministry of Corporate Affairs published the Committee on Digital Competition Law’s (Committee) Report (Report) dated 27 February 2024 along with a draft of the Digital Competition Bill, 2024 (DCB).
The Committee recommends introduction of a separate ex-ante legislation, applicable to digital enterprises that have significant presence in certain pre-identified Core Digital Services in India, susceptible to concentration, to be designated as Systemically Significant Digital Enterprises.
The DCB obligates enterprises to self-assess their threshold fulfilment requirements and recommends monetary penalties for the non-compliance with proposed ex-ante obligations.
