May 18, 2023In this alert, we highlight the key features of the SEBI’s proposal to introduce a framework by which special/nominee rights can be conferred upon unitholders of REITs and InvITs, as set out in its consultation paper titled “Special rights to unitholders and role of sponsor in REITs and InvITs”. If implemented, these changes are expected to provide much-needed clarity to investors on their ability to participate in the governance and decision-making of REITs and InvITs, through the board of directors of the manager/investment manager.
