SAM-inar: Shareholder disputes in India – New challenges and strategies

The webinar focussed on the Singapore Court of Appeal’s recent landmark judgment in Anupam Mittal v Westbridge Ventures II Investment Holdings. The Court of Appeal has provided instructive guidance on how to determine the law governing the arbitration agreement and its vital importance to the question of arbitrability of disputes. The panellists deliberated the implications of this judgment on shareholder disputes in Indian companies where allegations of oppression and mismanagement are involved, and where the parties have agreed to Singapore-seated arbitration to resolve disputes under a shareholders agreement. The judgment highlights the interplay between international arbitration and proceedings before the National Company Law Tribunals in India.
