Notable Judgements / Orders passed by the Supreme Court and High Court

This issue  of the newsletter brings to you the regulatory and policy updates relating to environment along with the notable orders and judgments passed by the Supreme Court of India, various High Courts and the National Green Tribunal during the month of August, 2021.

In Municipal Corporation of Greater Mumbai v. Nitin Shankar Deshpande case the Supreme Court has directed the Commissioner of the Municipal Corporation of Greater Mumbai to file an affidavit within two weeks before the NGT indicating the steps which have been taken to comply with the directions of the NGT particularly with respect to ensuring compliance with the requisite standards for the discharge of effluents including municipal waste and sewage. In another case the Supreme Court has ordered the demolition of twin towers in Emerald Court project constructed by the appellant, Supertech Limited as it was found to be illegal,  Supreme Court observes that availability of housing stock has to be balanced with protection of environment and safety of its occupants.
